3. Heard learned counsel for the parties to the lis.

4. We are of the considered opinion that since the

respondent-State has already settled the claim payable to the

contesting respondent herein, we expunge the adverse

remarks/strictures made by the High Court against the appellant.

5. To this extent, the impugned judgment and order is set

aside and the appeal is allowed partly. Parties to bear their own

costs.

Ordered accordingly.
